Default New QLD hoon laws...this is a worry.

Welcome to the police state..."hoon" once and get your car taken for three months, "hoon" again within five years and it gets crushed...

Seeing as how "hooning" isn't a legal term and can mean literally anything, how many people are going to get victimised by coppers having a bad day? How about the little old lady a while ago in the news who was said to be "hooning" when in fact she was just speeding?

I was cautioned a while back after driving the G6E around a roundabout in Bundaberg in the rain, and hit a greasy patch. The rear slid out, the traction control bit, and I corrected it. A copper was at the other entrance to the roundabout and followed me, pulling me over. He cautioned me and said he wouldn't charge me with "hooning", but I had better be careful.

So under the new laws, if he had been in a bad mood, I could have been in a town distant from my home and lost my car for three months. Nice.

Could say what i want, but i can guarantee id be on the ban list i can assure you.

Im no hoon, but 'spirited' sometimes gets involved, so well if that makes me a hoon so be it.

I have nothing against police doing their job either.

im all against people using the road as a rally track, but the reality is most accidents are caused by morons who dont pay attention to where they are going

for example the 60 year old yuppee with gold teeth who drove his BMW Z3 straight into my wife's car couple days ago because "he never seen her"

Good move, although a little ill conceived.
It will be like our new evade police laws. Big fine and loss of licence for two years, first case just came to court and the Magistrate has refused to enforce it as the punishment is "oppresive".

whats the definition of unnecessary acceleration??? I suspect that unnecessay speed is obviously speeding. but what unnecessary accelration?? they gunna start timing us too see how long it takes too get to the speed limit??? while i agree that hooning is a problem. i dont see how someone getting pinged at 70km/h in a 60km/h zone is a hoon or someone accelerating too get too the speed limit or overtaking is a hooning offence. also its not hard too lose traction in any car!!! I've lost control of a car around a roundabout in the wet once. hit an oil patch at 30km/h. I accelerated to correct it or do i now just crash my car into a gutter in fear of losing my car???

When the police charge you, you do not charge you with hooning, it will be careless driving and dangerous driving.

I think the main point is being missed here... the hoon laws AREN'T designed to punish Joe Citizen momentarily breaking traction at the lights or the enthusiast that decides to have a quick squirt (20-30, perhaps even 40 over) - it's designed to punish those who's actions put others lives in potential danger of being seriously injured and or killed

there are lesser offences such as speeding tickets, careless driving & failure to have proper control charges etc that can be used to prosecute without having to impound their vehicle

Some people don't realise that all it takes is that their moment of madness can change lives forever - and not just their own - I've seen it happen first hand and believe me, living with the aftermath is not a pleasant expirience at all...

Totally agree with you chridda, the only problem is that it is left to the disgression of the officer and because they see it as such a large problem that breaking traction no matter for how long will see you charged with hooning, taking of at the lights too quickly no wheel spinning at all, they can and have book/booked people for this. Now my g6e turbo gets to 60-70-80 quicker than my son's corolla so who is to determine how much quicker.
Look we recently had idiots going up and down our street doing burnouts these people I have no problem with them being charged and there cars crushed straight up to be honest, if their caught in the act of doing a burnout then crush it.
My problem with all this is this, what happens when they carn't get to work lose their jobs and then can no longer pay for the car, what happens if they just say stuff it im not paying for a car I don't have and declare bankrupt, whats happens then??
They need to clarify what hooning actually is, speeding is speeding not hooning e.t.c e.t.c.
Anyway thats my 2 cents worth.

The trouble is these laws are subjective..... It's not like .05 or exceeding the speed limit or running a light.

There have been plenty of anecdotal evidence of police using these laws for exactly what you say they wouldn't do.

IMO these hoon laws are a farce. They cover things that the police were already able to enforce but the pollies have just added that emotive ******** to them.

I don't like this. What if you happen to get some new young ******** cop on a powertrip, or one of those female cops who still lives in the 70's and thinks She has to justify Her place in a so-called mans world who nabs you for 20kph over the limit? Or even losing traction in the wet at a roundabout? (happens easily and sometimes unexpectantly) and decides to do you for careless driving?

Hopefully I'm just wrongly interpreting these laws as a direct oppression as opposed to a scare tactic for all the young Wayne Kerr P-Platers in their dodgy crapbox Commodores and Corollas.

Still don't agree with it though. All it's going to create is a lot of young people with debts and unpaid fines. Not saying I agree with completely irresponsible hoonery, but nothing is going to stop young people doing dumb stuff in their cars. The same generation that critiques said acts were more than likely responsible for it in their younger days too.

I guess revenue is a more attractive proposition than education and awareness.

Exactly...it's very very subjective. There's no such thing as a set-in-stone definition of "an hoon".
It's all down to the copper on the day...what to one cop will be "undue noise" to another will be "a hooning offence...give us your car for three months".
Police will victimise certain drivers of certain cars...we all know this. My son was pulled over for doing 118k's on the highway near here overtaking a truck that was dropping gravel all over the road (in my old very recognisable Celica, the only one in the area), and in the couple of weeks following that, I was pulled over twice for "random licence checks" and once for a "quick mechanical check" and rego check. I hadn't even been pulled over before out here, so you can't say they weren't actively targeting the car. Other guys with specialist cars like modified FPV's and HSV's and WRX's out here just shrugged and said "That's what you have to put up with...you become a very visible target for a while".

Anyone who thinks otherwise is very very naive...

Basically it's there to scare most fools , the real ones will get caught out , and the odd 1st timer will learn the hard way .

I watched the news tonight and they were talking about hooning
then panned across to a crusher with a Hyundai being crushed
I ask you do the tv stations really think Hyundais get used for hooning
then they cross to some stock footage
of Skylines doing do nuts in a factory carpark
which is what I would call hooning
anyway there has to be a different rule on carpark games
and roundabout slides in the wet
also just a legal thing
what if the car is under HP doesnt that mean the bank owns it
and impounding the car wouldnt be allowed
without the banks say so would it

hey could you technically get your car towed straight to a ford dealer to prove at said time or with in the last few kays the traction control hasnt been off. Would be hard to prove hooning if you cpu says your TC hasnt been off...SURELY

I agree it must be a proper decision made by sensible police.
In Adelaide, If Joe Citizen hates his neighbour, he can dob him in in for hooning and they will receive a fine in the mail.

How many coppers do you seeing sitting in their police car doing a burnout, illegal street racing, drifting or doing donuts? I don't recall seeing any. But that's not to say it doesn't happen. Maybe outside Krispy Kremes?

i have personaly seen a few when thye have taken delivery of a new pursuit vehicle and just have to see what it can do,one particular one comes to memory when they got a ba turbo for the first time after so many years of holden v8 and them being holden men just wanted to put it to the test,think i could still have some photos somewhere

Sigh.... so predictable, threads turned into police bashing.....

You know one way this law couldve been stopped was to not vote them in (ie read their policies before you all voted). This was part of their policy platform.

The world is going broke and they need to rip more money out of you!.

In SA atm your a creep if you go 1km over the limit and you contribute to killing people on the road, might as well end it all now .


One day all this pushing will have to reach a end, hopefully before we are all programed robots.

I have no problem with the laws....IF they finally start giving people places to release these urges to do burnouts, drifting in a safe controlled environment.

We consider our country so advanced and ahead that so many middle eastern countries but look what they are doing at the moment, a lot of the countries have opened what they are calling motor parks all over the place where people can go to a controlled environment away from the streets and do these things.


They punish us for doing it but give us no where to do it I'm a controlled environment.

Awhile ago me and about 5 mates went out to the middle of nowhere to do some burnouts at 3 In the morning no where near any houses or anything, unfortunately a cop showed up and threatened to do us with hooning. After talking to us and realising we were all reasonable people who had no where to do it but had done everything we could to involve no one else he let us be. We had strict rules for us that night it ncr one person in the car every ether car was well back and if anyone else thought something wasn't right or the person was getting stupid/out of control we mould flash lights from another car and the person would stop.

So my only problem is give us somewhere to do it safely and we won't do it on the roads... Yes it's illegal but hey so is drugs but how many injection clinics are around?

Perhaps you shouldn't be thinking of Blackwater-Emerald as being representative of the rest of the state,
since moving to Brisbane, I can see a lot of justification for the laws, at least people are aware of the consequences.

One man's victimization is another man's targeting of problem areas.
While there may be no legal definition of the term "Hoon", there is for anti-social behavior.

And I agree,
targeting Hi Perf cars is not necessarily the best way to solve this problem, people in all sorts of cars
can drive with anti social behaviour, so branding just one sector misses the real problem.

Nothing to worry about. NSW has had similar laws for years and not one car has been crushed (the legalities apparently are a nightmare: insurance, finance, definition of "hoon", admissable evidence etc). It's just chest beating from the govt. that's all.
