the owner is inusred. Lodge a claim on your own policy, let your insurer know all the details of what happened. I assure you if they believe that the law (unsure of american liability laws) would mean the repairer/mechanic/technician should be responsible, they will sue the repaier for the recovery.

Reading the blurb, he claims it would be unfair to expect his small business to carry such insurance, to boot, he added a personal injury claim to the owner of said car. So Im guessing not.

Not sure what it is like in the US but here a crash like that would involve an investigation from major crash section of the police here. They will be able to determine the cause of the crash and the speeds involved from the damage to the car, the trees and the length of skid marks. The will also be able to determine what was crash damage and what is towie damage (I highly doubt much of that is towie damage). I am also not sure of the technical aspects of the vehicle ECU but many do data log and Ford could investigate which would show vehicle speed, % of throttle, boost, brake application and status of traction control etc. All these details could look very bad for the driver.

I am sure someone with enough cash to buy and modify a GT also has enough financial capacity to fund a law suit that will cream the tuner. Considering the tuner has no liability insurance, bye bye business and rightly so.

If I had such a vehicle, there is no way I would send it to an uninsured workshop.

I like the way that Bill Knobloch basically turns around and says “ I wrecked your car, bad luck, but luckily for you, I wasn’t hurt badly but I’ll sue you anyway”.

These Fords aren’t fitted with traction control.
Maybe so, but does the ECU data log other inputs? Many of the Ford ECU's do (for example BF-FG do).

Looking at the damage, there is no way the towie did that damage. The tuner is an outright liar.

I'd be keen to find out how many wokshops/tuners actually have public liability insurance and workshop insurance. In my field no one gets paid without providing current certificates of currency for workers compensation and public liability. I'd have no hesitation asking the same before handing over money for works carried out.

Don’t know about that, there’s some pretty average towies out there.

I’m quite sure that the towie would have taken plenty of pics, and in a case with a car as expensive as this, he could have had someone video the salvage operation just to cover his backside.

When you mess with cars like this, you mess with owners who have a have a lot of cash, and we all know that big money buys a lot of justice.
