They “repaired” my car and then said I wasn’t “entitled” to a replacement car .

Pretty shonky to be honest, they replaced the TCM and the clutch and it’s still playing up, pretty frustrating .

No matter how many times it’s replaced/repaired it’ll always be a defect

I say this all the time, if you want to open a case do not under any circumstances let them touch your car.

You have to let them repair your car, because it has to go in for a diagnostic.
If they don’t fix the car they’d just tell me to come pick it up and that there’s nothing they can do for me .

The problem is everyone with these defected cars are in the same boat yet individuals get such varied outcomes.
There’s plenty who have been given whole refunds or new cars and then there’s people like me that get given nothing but a headache

It’s a 2013 car and done 53,000 kms, it barely gets used, it does very little kms with me. It’s not used daily.

It definitly shouldn’t be needing constant clutch and TCM replacements lol

Curious which dealer was it you went to? Some dealers can help, others can hinder the issue, pending if they know what they are doing.

Bayford Ford Epping is the dealer liaising with head office for me, but I’ve been hounding head office all week and have received an updated email this morning offering me a partial refund of $9200

Gotta love how people criticise the way the car is used... like telling you not to go into stop-start traffic.

What are you supposed to do when traffic banks up? I guess you could just park the car on the side of the road and wait for everyone else to go to bed so that you can drive the rest of the way home but it's not really ideal.

The transmission is notorious for being a POS that Ford should never have put into a road car. I'll gladly sign the petition.

Yeah, thats probably the market value they'll on sell it for, so they arent really taking responsibility for it, just giving you what they'll recover themselves whilst you lose the difference between that and what you paid.

I'd stand my ground, you paid for their stuff up, so too should they.

This is what my reply back to them was

Dear Ford Australia,

I’m writing in regards to the email I received this morning (18-02-2019) offering a partial refund in relation to my defected power shift vehicle.

I appreciate the reply but my resolution request was a replacement vehicle.
My reasoning to opt for a replacement vehicle is because of my personal situation.
I have no family situated where I live, the closest is 3 hours away.
I have a one year old son with personal needs, my need for a vehicle is imperative hence I purchased the vehicle I have now, without a vehicle I will not be able to complete my daily activities/needs and if I was to get a full refund I wouldn’t have a means of transport to seek to buy another car.

I have liaised with the ACCC today and came to the conclusion I can only settle if offered a replacement vehicle that isn’t defected.

I, and everyone else class these defected vehicles to have a major defect, as they threaten consumers safety and cannot be used up to a fair standard that we purchased them for.
It doesn’t matter how many times these cars are repaired, the faults continuously happen as it cannot be permanently repaired and there’s substantial evidence of this.

I have previously explained in past emails the threats towards my safety and also my sons on occasions while I’ve been driving this car, this has happened on three different occasions and I have no doubt this will happen again if I continue to drive this faulty vehicle.
Because of this I would kindly ask Ford Australia to consider pursuing my request for a replacement vehicle that is safe and up to standard to use as an everyday vehicle.

I would appreciate Ford Australia adhering to its own customer charter and also Australian consumer laws which I’ve attached below.

As it stands now I’m unable to drive my car, because I’m terrified to do so due to its faults.

To purchase a car as of now, it would cost a lot more than the offered partial refund.
When I purchased my car which is a 2013 Focus titanium model it was 2017, so the car was 4 years old.
So if I was to purchase a car now which is the equivalent of being the same age as my car was when I purchased it, the car would need to be 2015.
I have attached some various adverts of the same model car made in 2015 for an indication on price. And please take into account these cars have more KM’S on the clock in comparison to my car.

Please take all of these into account.

I look forward to hearing from you in the near future.

Kind regards, Kelly Van Brummelen.

Exactly!!!! They can’t say all 70,000 with these faulty cars drive the same lol

Hence why Ford got pinged by the ACCC. Telling people it's the way they drive it moronic. It's a garbage auto that should never have gone into a car that would be used mainly in the city/extra urban.

Exactly right, they need to admit it’s garbage and can’t be fixed and give the people who have these cars what they deserve ...

The fact that fraud is still putting consumers through this is abysmal.
This is one of the most pathetic reactions and those decision makers ie bean counters and ambulance chasers as well as frauds management team should be ashamed of themselves.
Actions like this are inexcusable..
Ford... For once, do the right thing by those caught out with this crappy product and help them move forward,
People like this who work hard to scrape up money to buy ur product deserve to be helped, not treated like nothing.

Tbh reflects on the dealer that sold it too, they know the issues and still moved it on again claiming it's fine.. Pathetic, I was lucky years ago when I went to look at one before it all became public knowledge when my dealer at the time warned me to stay away from them due to dodgy autos.. And yes it was a ford dealer

I believe Ford have no legal obligation to kellyvb. She didn’t buy the car from Ford. She bought a 4 year old car. Under Australian consumer law the retailer is responsible for the product.
Despite this Ford are paying for repairs on the clutch and tcm for 10 years.
I’d say that’s more than reasonable.
When was the last clutch fitted to this car?
Exactly what is the problem with the car now? Exactly?
Ford dealers around the country fix these cars for free every single day.

Out of curiosity, would you own a power shift focus?

I'd have to disagree, this transmission is a known fault, so much so that as I mentioned earlier, before it became public knowledge, a ford dealer was the first person to tell me to stay away from them due to the clutch faults.

It's even a matter of a class action, let's not downplay it, they are lemons in auto form

No I wouldn’t buy one. I wouldn’t buy any duel clutch auto. I don’t like how they drive.
I also would buy a diesel because the cost of repairs is too high. But out top 2 best selling vehicles in Australia are diesels.

I wouldn’t recommend any duel clutch auto. Even $500,000 sports cars have exactly the same problems.

I’m not downplaying any of the issues. I’m simply pointing out Ford has no legal obligation to the op. Of course I’m no lawyer and it’s just my opinion.

Also pointing out Ford continues to pay for replacement of clutches and tcm modules on cars that are many years out of factory warranty. Was VW so kind with dsg repairs? Plenty of people paying $12,000 for new dsg boxes.
